Terms of Service

1. Acceptance of Terms

By accessing, registering for, or using IntelSpec (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms apply to all users of the Service, including free tier users and paid subscribers. We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Service. Your continued use following the posting of revised Terms means that you accept and agree to the changes.

2. Description of Service

IntelSpec is a cybersecurity threat intelligence platform that provides Open Source Intelligence (OSINT) analysis powered by artificial intelligence. The Service aggregates data from 28+ public intelligence sources, applies confidence scoring, source attribution, and reasoning chains to deliver transparent threat findings.

We offer multiple subscription tiers:

• Free Tier: Limited OSINT feeds, basic alert rules
• Professional Plan ($79/month): Full OSINT access, API integration, priority support
• Business Plan ($199/month): Team collaboration, custom collectors, audit logging
• Enterprise Plan ($499/month): Dedicated support, SLA guarantees, compliance features

The specific features available depend on your subscription tier. We reserve the right to add, modify, or discontinue features at our discretion.

3. Account Registration & Security

To use the Service, you must register an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to:

• Use a strong password and change it regularly
• Notify us immediately of any unauthorized use of your account
• Not share your credentials with other users
• Use multi-factor authentication if enabled for your plan

We are not responsible for any loss or damage arising from your failure to maintain account security. If you believe your account has been compromised, contact us immediately at support@intelspec.io.

4. Subscription Plans & Billing

Free Tier: No credit card required. Free tier accounts may be suspended or terminated if unused for 90 consecutive days. Features may be limited compared to paid plans.

Paid Subscriptions: Paid plans are billed monthly on a recurring basis using Stripe. You authorize us to charge your payment method on the first day of your billing cycle. Billing will continue each month until you cancel.

Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial months or unused service. If you cancel during a billing cycle, your service will continue until the end of that month.

Price Changes: We may change subscription prices with 30 days' notice. Continued use of the Service after the price change constitutes acceptance of the new price.

Failed Payments: If a payment fails, we will attempt to collect the payment again. If payment fails after multiple attempts, your subscription may be suspended or terminated.

5. Acceptable Use Policy

You agree not to use the Service for any unlawful purpose or in any way that violates these Terms. Specifically, you agree not to:

• Conduct unauthorized network scanning, port scanning, vulnerability testing, or penetration testing against systems you do not own or have permission to test
• Use the Service to facilitate hacking, cracking, or unauthorized access to any system
• Resell, redistribute, or sublicense intelligence data obtained from the Service without written permission
• Reverse engineer, decompile, or attempt to discover the source code or algorithms used by the Service
• Use the Service to harass, threaten, or harm any individual or organization
• Violate any applicable laws, regulations, or third-party rights in your jurisdiction
• Spam, phish, or conduct social engineering attacks
• Interfere with or disrupt the infrastructure or services of IntelSpec or other systems
• Use automated tools to scrape or extract data from the Service in violation of our API terms

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund.

6. Intellectual Property

All content, code, designs, graphics, and materials in the Service are owned by IntelSpec LLC or our content providers and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes, subject to these Terms. You may not:

• Copy, modify, or create derivative works based on the Service
• Reproduce or distribute any portion of the Service
• Use the Service's trademarks, logos, or branding without written permission

Intelligence data collected from public sources retains the intellectual property rights of the original source. We provide attribution for all data sources.

Your use of data obtained from the Service is limited to your internal threat intelligence and security operations. Commercial resale or redistribution is strictly prohibited.

7. AI-Generated Content Disclaimer

IntelSpec uses artificial intelligence to generate threat analysis, confidence scores, reasoning chains, and other intelligence products. While we employ rigorous validation techniques, AI-generated content is provided for informational purposes only and should not be considered guaranteed or error-free.

You acknowledge and agree that:

• AI analysis may contain inaccuracies, false positives, or false negatives
• Confidence scores reflect our algorithms' assessment but do not guarantee accuracy
• You should independently verify critical findings before taking action
• The Service is a decision support tool, not a replacement for human analysis
• IntelSpec is not liable for decisions made based solely on AI-generated findings

We encourage you to review source data, verify findings against multiple sources, and apply your own expert judgment when acting on intelligence derived from the Service.

8. Data Collection & OSINT

IntelSpec collects intelligence exclusively from publicly available sources, including but not limited to:

• Vulnerability databases (CVE, NVD)
• Breach notification records and data leaks
• Security researcher disclosures and threat reports
• Public DNS records and IP reputation databases
• Open-source intelligence feeds and blogs
• Social media and public forums
• Industry threat intelligence feeds

We explicitly do not:

• Conduct unauthorized network scanning, hacking, or intrusion
• Access private systems or networks without permission
• Intercept private communications
• Conduct social engineering attacks
• Violate any laws or regulations in data collection

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes our practices for collecting, using, and protecting your personal information. Please review our Privacy Policy at intelspec.io/privacy.

By using the Service, you consent to the data practices described in our Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by law, IntelSpec LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunity, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you have paid to IntelSpec in the 12 months preceding the claim. If you have not paid IntelSpec anything, our liability shall not exceed $100.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

The Service is provided "as is" without warranties of any kind, express or implied. IntelSpec does not warrant that the Service will be uninterrupted, error-free, or free from harmful components.

11. Indemnification

You agree to indemnify, defend, and hold harmless IntelSpec LLC, its affiliates, and their respective officers, directors, employees, and agents from any claim, demand, loss, or liability (including reasonable attorneys' fees) arising from or related to (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any applicable law or third-party right.

12. Termination

You may terminate your account at any time by logging into your account settings and following the cancellation process. Paid subscribers will have access until the end of their current billing period.

IntelSpec may terminate or suspend your account at any time, with or without cause, upon notice to you. Grounds for immediate termination include:

• Violation of these Terms or the Acceptable Use Policy
• Unlawful or fraudulent activity
• Continued payment failures (for paid accounts)
• Violation of applicable law
• Use of the Service to cause harm to IntelSpec or other users

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for backup purposes. No refunds are provided for terminations due to violation of these Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles.

You agree to submit to the exclusive jurisdiction of the state and federal courts located in Massachusetts for resolution of any disputes arising from these Terms or your use of the Service.

14. Changes to Terms

IntelSpec reserves the right to modify these Terms at any time. We will notify you of material changes by email or by posting a notice on our website. Your continued use of the Service after such notification constitutes acceptance of the modified Terms.

If you do not agree to the modified Terms, you should discontinue your use of the Service.

16. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and IntelSpec regarding the Service and supersede all prior agreements and understandings.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

Assignment: You may not assign or transfer these Terms or any rights or obligations without our written consent. IntelSpec may assign these Terms to any successor or affiliate.

No Partnership: Nothing in these Terms creates a partnership, agency, or joint venture between you and IntelSpec.
